นโยบายความเป็นส่วนตัว

บทนำ

บริษัท บราเธอร์ พิคเจอร์ จำกัด ("บริษัท" "พวกเรา" "เรา" หรือ "ของเรา") จัดทำนโยบายความเป็นส่วนตัวฉบับนี้ ("นโยบายความเป็นส่วนตัว") ซึ่งสรุปนโยบายและขั้นตอนการรวบรวมข้อมูล การใช้ และจัดเก็บข้อมูลส่วนบุคคลของผู้ใช้งานแอปพลิเคชัน (“ผู้ใช้งาน” หรือ “ท่าน”) บนแอปพลิเคชัน YAKLAND หรือ ดินแดนยักษ์ (“การให้บริการ” หรือ “แอปพลิเคชันของเรา”) เมื่อท่านติดตั้ง รวมถึงเข้าใช้งานแอปพลิเคชันของเรา เรียกรวมในที่นี้ว่า “การใช้บริการของเรา”

นโยบายความเป็นส่วนตัวนี้บังคับใช้สำหรับการรวบรวม การใช้ และ การจัดเก็บข้อมูลส่วนบุคคลซึ่งท่านได้ยินยอมให้ไว้กับเรา ซึ่งท่านได้ดำเนินการผ่าน

แอปพลิเคชันของเรา บนโทรศัพท์เคลื่อนที่/อุปกรณ์ดิจิทัลของท่าน รวมถึง Emulator (อีมูเลเตอร์) หรือโปรแกรมจำลองของแอนดรอยด์บนเครื่องคอมพิวเตอร์ เช่น Bluestacks (บลูแสต็คส์) และ Nox Player (น็อกซ์ เพลเยอร์) เป็นต้น
แอปพลิเคชันของพวกเราที่สามารถเข้าถึงการบริการเครือข่ายทางสังคม Social Network Service (SNS) เช่น Google Account และ Facebook Account เป็นต้น

โปรดอ่านและทำความเข้าใจนโยบายความเป็นส่วนตัวนี้อย่างละเอียด การที่ท่านได้ติดตั้ง ลงทะเบียนบัญชีผู้ใช้ และ/หรือเข้าใช้งานแอปพลิเคชัน YAKLAND หรือ ดินแดนยักษ์ นี้แล้ว ถือว่าท่านตกลงยอมรับข้อกำหนดที่ระบุในนโยบายความเป็นส่วนตัวนี้แล้วทุกประการ หากท่านไม่สามารถยอมรับข้อกำหนดนโยบายความเป็นส่วนตัวนี้ได้ ขอให้ท่านปฏิเสธการใช้งานแอปพลิเคชันโดยถอนการติดตั้งแอปพลิเคชันจากเครื่องโทรศัพท์เคลื่อนที่/อุปกรณ์ดิจิทัศน์ของท่านทันที

ทางเราขอแจ้งให้ทราบว่า จะไม่มีการใช้ข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์อื่นใดนอกเหนือจากการให้บริการ หรือตามที่กฎหมายกำหนด

การเก็บรวบรวมข้อมูลส่วนบุคคล

รายละเอียดส่วนบุคคลที่ทำการรวบรวม

เมื่อท่านดำเนินการลงทะเบียนบัญชีผู้ใช้ผ่านแอปพลิเคชันของเรา หมายความว่าท่านได้ยินยอมให้สิทธิเราในการเก็บรวบรวม บันทึก และใช้ข้อมูลส่วนบุคคลของท่าน ตามนโยบายความเป็นส่วนตัวฉบับนี้ ซึ่งข้อมูลดังกล่าวอาจรวมถึง

อายุหรือวันเกิด
ชื่อและนามสกุล
อีเมลและเบอร์โทรศัพท์
รหัส และข้อมูลอื่นที่จำเป็นเพื่อความปลอดภัยของบัญชีผู้ใช้
ข้อมูลการเรียกเก็บเงิน
ข้อมูลโพรไฟล์ และที่เกี่ยวกับโพรไฟล์ทั้งหมด
การตั้งค่าการเล่นเกม และ การเชื่อมต่อไปยังโพรไฟล์บน SNS ต่างๆ เช่น Google Account และ Facebook Account
ข้อมูลการใช้งานแอปพลิเคชัน

ทางเราจะทำการรวบรวมข้อมูลและรายละเอียดการใช้งานแอปพลิเคชันของเรา เช่น จำนวนครั้งในการเข้าเล่นเกม คะแนน และอับดับของท่าน (Score และ Ranking) รวมถึงการซื้อสินค้า (Virtual Goods) การใช้เงินเสมือนจริง (Virtual Money) และ การแลกแต้ม (Point Exchange)

ทางเราจะทำการรวบรวมข้อมูลการปฏิสัมพันธ์ระหว่างผู้ใช้งานด้วยกัน ได้แก่ การแชร์ข้อมูลใดๆของแอปพลิเคชันผ่านทางสื่อสังคม (Social Media) เช่น คำเชิญ การแชร์อันดับ หรือ การแชร์ภาพหน้าจอ ฯลฯ

หากท่านดำเนินการซื้อสินค้า เช่น ไอเทม หรือคอสตูม ที่จำหน่ายในแอปพลิเคชัน กล่าวคือ การซื้อสินค้าเสมือนจริง (Virtual Goods) และการใช้เงินเสมือนจริง (Virtual Money) ผู้ให้บริการทางการเงินจะดำเนินการรวบรวมข้อมูลการชำระเงินและเรียกเก็บเงิน รวมถึงข้อมูลที่จำเป็นในการทำธุรกรรมทางการเงิน ซึ่งข้อมูลดังกล่าวอาจรวมถึง

ชื่อและนามสกุล
ที่อยู่อีเมล
ข้อมูลบัตรเครดิต Mobile Banking หรือบุคคลที่สามที่ให้บริการด้านการชำระเงินออนไลน์ เช่น PayPal หรือ True Money Wallet
ที่อยู่สำหรับการเรียกเก็บเงินและออกใบกำกับภาษี
พันธมิตรหรือบุคคลที่สามของเราอาจได้รับข้อมูลเหล่านี้ เมื่อท่านทำการชำระเงินผ่านโทรศัพท์เคลื่อนที่/อุปกรณ์ดิจิทัศน์

นอกจากนี้ ทางเราจะดำเนินการรวบรวมข้อมูลและรายละเอียดการติดต่อสื่อสารที่ท่านได้ติดต่อกับทางเรา ได้แก่ การแจ้งปัญหาการใช้งาน การร้องเรียน ข้อเสนอแนะ ทางเราจะรวบรวมและจัดเก็บข้อมูลที่ใช้ในการติดต่อ ซึ่งอาจรวมถึงที่อยู่อีเมลของท่าน ทั้งนี้รายละเอียดในการสนทนาผ่านช่องทางดังกล่าว จะถูกจัดเก็บไว้ด้วย เพื่อเป็นแนวทางในการปรับปรุงและพัฒนาการบริการของเราต่อไป

การใช้งานคุณลักษณะเฉพาะ (Features) ที่ทางเราให้บริการ

หนึ่งในคุณลักษณะเฉพาะ (Features) ที่ทางเราได้จัดเตรียมไว้ให้ท่าน คือ โพรไฟล์ (Profile) เพื่อให้ท่านได้แสดงข้อมูลเกี่ยวกับตัวท่าน และใช้ในการเพิ่มเพื่อน พูดคุย จัดอันดับ เข้าร่วม หรือแข่งขันกับผู้ใช้งานรายอื่น รวมถึงอาจมีช่องแช็ต (Chat box) ซึ่งเป็นพื้นที่สาธารณะ สำหรับติดต่อสื่อสารระหว่างผู้ใช้งาน ทั้งนี้หากท่านได้มีการโอนถ่ายข้อมูล (upload) จำพวกภาพถ่าย หรือ หากท่านได้ทำการเปิดเผยข้อมูลส่วนบุคคลโดยสมัครใจในพื่นที่ซึ่งเป็นสาธารณะ ถือว่าท่านให้สิทธิต่อผู้อื่นในการรวบรวมข้อมูลและใช้งานข้อมูลดังกล่าวได้ การเผยแพร่ดังกล่าวอยู่นอกเหนือการคุ้มครองโดยนโยบายฉบับนี้ ดังนั้น ทางเราขอแนะนำให้ท่านโปรดระวัง และใช้ดุลยพินิจในการเปิดเผยข้อมูลส่วนบุคคลของท่านอย่างถี่ถ้วน

ข้อมูลที่ได้รับผ่านการเชื่อมต่อผ่าน SNS

เมื่อท่านใช้แอปพลิเคชัน Social Network Service (SNS) และได้อนุญาตให้เราเข้าถึงข้อมูลบางอย่างจากโปรไฟล์ของท่านผ่าน SNS ดังกล่าว รวมถึง Application Programming Interface (API) ของสื่อต่างภูมิทัศน์ (Platform) SNS ที่เกี่ยวข้อง ข้อมูลที่ทางเราจะได้รับผ่าน SNS นั้น เป็นข้อมูลที่ท่านได้อนุญาตไว้แล้ว ได้แก่

ชื่อและนามสกุล
รูปโพรไฟล์
หมายเลขบัตรประจำตัวประชาชน (หากมี)
หมายเลข ID ผู้ใช้งาน
ที่อยู่อีเมลสำหรับเข้าสู่ระบบที่ท่านให้ไว้กับ SNS เมื่อท่านลงทะเบียน
ตำแหน่งทางกายภาพของท่านและอุปกรณ์การเข้าถึงของท่าน
เพศสภาพ

การลงทะเบียนผู้ใช้ เชื่อมต่อ และ/หรือใช้แอปพลิเคชันของเราผ่าน SNS นั้น ท่านได้ยินยอมให้เรารวบรวม จัดเก็บ และ ใช้ข้อมูลทั้งหมดที่ท่านตกลงให้ SNS เปิดเผยให้เราทราบผ่านทาง API ตามนโยบายความเป็นส่วนตัวฉบับนี้ ข้อตกลงของท่านจะปรากฏเป็นหลักฐานเมื่อท่าน "ยอมรับ" หรือ "อนุญาต" แอปพลิเคชันของเราผ่านทาง SNS

การรวบรวมข้อมูลตำแหน่งที่ตั้ง

เมื่อท่านใช้งานแอปพลิเคชัน YAKLAND หรือ ดินแดนยักษ์ ท่านจำเป็นที่จะต้องเปิดตั้งค่าระบุตำแหน่งที่ตั้ง “บริการหาตำแหน่งที่ตั้ง” หรือ “การเข้าถึงตำแหน่งของฉัน” หรือคำอื่นๆที่มีความหมายเดียวกัน เพื่อให้สอดคล้องกับรูปแบบการให้บริการของเรา ทั้งนี้ทางเราอาจเข้าถึง ประมวลผล และรวบรวมตำแหน่ง ณ ขณะที่ท่านและผู้ที่อยู่ใกล้เคียงเปิดใช้งานแอปพลิเคชัน หรือตำแหน่งที่แท้จริงของท่านและผู้ที่อยู่ใกล้เคียง ซึ่งทางเราอาจใช้เทคโนโลยีหลายประเภทในการระบุตำแหน่ง เช่น ที่อยู่ Internet Protocol (IP) หรือ ระบบกำหนดตำแหน่งบนโลก (GPS) รวมถึงเครื่องรับรู้ (Sensor) หรือเครื่องมืออื่นๆ ที่อาจให้ข้อมูลเกี่ยวกับเครื่องโทรศัพท์เคลื่อนที่/อุปกรณ์ดิจิทัศน์ที่อยู่ใกล้เคียงจุดการเชื่อมต่อ Wireless Fidelity (Wi-Fi) และเสาสัญญาณ รวมถึงผู้ให้บริการเครือข่ายของท่านด้วย

การใช้เทคโนโลยีรวบรวมข้อมูล

เมื่อท่านเข้าถึง และ/หรือใช้บริการของเรา ทางเราจะดำเนินการรวบรวมข้อมูลทางเทคนิคบางประการเพื่อใช้งานภายในของเราเท่านั้น

คุกกี้ (Cookies)

คุกกี้ (Cookies) คือ แฟ้มข้อความ (Text File) ขนาดเล็ก ที่ถูกสร้างขึ้นโดยอัตโนมัติเมื่อท่านใช้เว็บเบราว์เซอร์ (Web Browser) คุกกี้ จะถูกเก็บบันทึกเอาไว้ในคอมพิวเตอร์ของท่าน ตามปกติแล้วคุกกี้จะไม่มีการบันทึกข้อมูลส่วนตัวของผู้ใช้ แต่ถ้ามีความจำเป็น ข้อมูลก็จะถูกเข้ารหัสเอาไว้ เพื่อป้องกันไม่ให้มีบุคคลที่สามสามารถนำข้อมูลส่วนตัวของท่านไปใช้งานได้ ทั้งนี้เราอาจใช้คุกกี้เพื่อติดตามข้อมูลทั่วไปของท่านที่ไม่ใช่ข้อมูลส่วนบุคคล อาทิเช่น ชื่อผู้ใช้งาน และ เกม เพื่อวัตถุประสงค์ในการวิจัยทางสถิติและการตลาดเท่านั้น นอกจากนี้เราอาจใช้ แฟลชคุกกี้ (Flash Cookies) ซึ่งเป็นเครื่องมือในการช่วยเราป้องกันการฉ้อโกง จดจำการตั้งค่าในเกมของท่าน และติดตามความคืบหน้าต่างๆในเกม อย่างไรก็ดี ท่านสามารถปฏิเสธหรือจำกัดประเภทของคุกกี้ได้ ทั้งนี้การกระทำดังกล่าวอาจทำให้ท่านไม่สามารถเข้าถึงคุณลักษณะเฉพาะ (Features) บางอย่างที่ทางเราให้บริการได้ และโปรดทราบว่า ท่านได้อนุญาตให้แฟรชคุกกี้ทำงานได้ โดยจะไม่ทำการลบแฟรชคุกกี้นั้น

การบันทึก Log Files

แฟ้มลงบันทึกเข้าออก (Log Files) คือ ข้อมูลจราจรคอมพิวเตอร์ ที่เกี่ยวข้องกับการติดต่อสื่อสารของระบบคอมพิวเตอร์ แสดงถึงแหล่งกำเนิด ต้นทาง ปลายทาง เส้นทาง เวลา วันที่ ปริมาณ ระยะเวลา ชนิดของบริการ หรืออื่น ๆ ที่เกี่ยวข้องกับการติดต่อสื่อสารของระบบคอมพิวเตอร์ ซึ่งทางเราจะมีการบันทึก Log Files ไว้ในเซิร์ฟเวอร์ ข้อมูลใน Log Files ประกอบด้วย Internet Protocol (IP) ของคอมพิวเตอร์ หรือโทรศัพท์เคลื่อนที่/อุปกรณ์ดิจิทัศน์ของท่าน รวมถึง เบราว์เซอร์ ภาษาของเบราว์เซอร์ แอปพลิเคชัน อีเมล ผู้ให้บริการอินเทอร์เน็ต การอ้างอิง ประเภทสื่อต่างภูมิทัศน์ (Platform) คอมพิวเตอร์ การประทับวันที่/เวลา และ กิจกรรมของผู้ใช้งาน ทางเราจะใช้ข้อมูลเหล่านี้ในการวิเคราะห์แนวโน้มการให้บริการ เพื่อปรับปรุงผลิตภัณฑ์และบริการให้ดียิ่งขึ้น ทั้งนี้ข้อมูลในไฟล์ดังกล่าวประกอบด้วยข้อมูลบัญชีผู้ใช้ การตั้งค่า การตั้งค่าการแจ้งเตือนระบบ ตลอดจนข้อมูลอื่นที่จำเป็น ข้อมูลบางอย่างหรืออาจจะทั้งหมด อาจถูกสำรองไว้ที่การสำรองข้อมูลเซิร์ฟเวอร์ (Backup Server) ซึ่งทางเราจะดำเนินการสำรองข้อมูลอยู่เป็นประจำ

การใช้งานเว็บบีคอน (Web Beacons)

การบริการของเราอาจมีการใช้งานเว็บบีคอน (Web Beacons) หรือ แท็กส์อินเทอร์เน็ต แท็กส์พิกเซล ทั้งนี้เว็บบีคอน คือ รูปภาพกราฟิกขนาดเล็กที่อาจรวมอยู่ในการบริการหรือบนสื่อต่างภูมิทัศน์ (Platform) มีวัตถุประสงค์เพื่อวิเคราะห์รูปแบบการเข้าชม ความถี่ของผู้ใช้งานที่เยี่ยมชมพื้นที่ต่างๆภายในบริการของเรา แท็กบีคอนจะช่วยให้เราปรับปรุงการโฆษณาให้มีประสิทธิภาพมากยิ่งขึ้น วิธีการนี้อาจเกี่ยวข้องกับการส่งต่อข้อมูลไปยังบุคคลอื่น ซึ่งข้อมูลที่เรารวบรวมและแบ่งปันนี้จะไม่สามารถระบุตัวตน ที่อยู่ และหมายเลขโทรศัพท์ของท่านได้

การโฆษณาแอปพลิเคชันผ่านบุคคลที่สาม

ทางเราอาจมีการลงโฆษณาผ่านบุคคลที่สาม ซึ่งบุคคลที่สามเหล่านี้อาจใช้คุกกี้ เว็บบีคอน หรือเทคโนโลยีการรวบรวมข้อมูลอัติโนมัติที่คล้ายคลึงกันจากคอมพิวเตอร์หรือโทรศัพท์เคลื่อนที่/อุปกรณ์ดิจิทัศน์ของท่าน การรวบรวมข้อมูลมีวัตถุประสงค์เพื่อนำข้อมูลมาใช้ในการกำหนดและวัดประสิทธิภาพของโฆษณา โปรดทราบว่าการรวบรวมข้อมูลเหล่านี้ไม่สามารถระบุตัวตนของท่านได้ ซึ่งทางเราอาจแบ่งปันข้อมูลที่ไม่สามารถระบุตัวตนของท่านได้ดังกล่าวในฐานะผู้ใช้งานแอปพลิเคชัน เพื่อให้บุคคลที่สามสามารถแสดงโฆษณาบนเครือข่ายโฆษณาของเขาได้มีประสิทธิภาพมากยิ่งขึ้น อย่างไรก็ดี การใช้คุกกี้ เว็บบีคอน หรือเทคโนโลยีการรวบรวมข้อมูลจากโฆษณาของบุคคลที่สาม อยู่ภายใต้นโยบายความเป็นส่วนตัวของบุคคลที่สามนั้น ทางเราจะไม่ขอรับผิดชอบต่อกิจกรรมใดๆ ที่ท่านได้ให้ข้อมูลส่วนบุคคลหรือมีปฏิสัมพันธ์กับบุคคลที่สาม ทางเราขอแนะนำให้ท่านอ่านการนโยบายความเป็นส่วนตัวของบุคคลที่สามก่อน และหากท่านมีข้อสงสัยประการใด โปรดติดต่อบุคคลที่สามเหล่านั้นโดยตรง

การคลิก Link หรือ URLs

หากมีการติดต่อสื่อสารระหว่างเราและท่านผ่านช่องทางต่างๆ เช่น อีเมล หรือ ข้อความแจ้งเตือนในแอปพลิเคชัน อาจมีการใช้วิธี คลิกลิงก์ (Click Link) หรือ Uniform Resource Locator (URLs) ที่เชื่อมโยงกับเนื้อหาอื่นๆที่เกี่ยวข้องกับการให้บริการ ทางเราจะมีการติดตามข้อมูลผ่านการคลิกนี้ เพื่อช่วยในการวิเคราะห์ความสนใจของท่านในการใช้งานแอปพลิเคชันของเรา

วัตถุประสงค์ในการรวบรวม และจัดเก็บข้อมูลส่วนบุคคล

ทางเราจะไม่ใช้ หรือ เปิดเผยข้อมูลส่วนบุคคลของท่าน อย่างไรก็ดี ทางเราอาจมีการส่งต่อข้อมูลส่วนบุคคลของท่าน ให้แก่บุคคลที่สามผู้ซึ่งเป็นผู้ให้บริการด้านการโฆษณาของเรา หรือ ผู้ให้บริการด้านอื่นๆที่เกี่ยวข้องกับการให้บริการแอปพลิเคชันนี้

ทางเรามีจุดประสงค์ในการใช้ข้อมูลส่วนบุคคลของท่าน ดังนี้

เพื่ออนุญาตให้ท่านลงทะเบียนและใช้บริการของเรา
ใช้ตรวจสอบและวิเคราะห์ข้อมูล เพื่อให้การบริการเป็นไปอย่างราบรื่น
เพื่อวัตถุประสงค์ในการวิจัยทางการตลาด รวมถึงวิเคราะห์ลักษณะของผู้ใช้งานและรูปแบบการใช้งาน
เพื่อติดต่อสื่อสารกับท่านเกี่ยวกับบัญชีผู้ใช้ของท่าน
เพื่อส่งประกาศ จดหมายข่าว และข้อมูลอื่นๆที่เกี่ยวกับการบริการของเรา
เพื่อป้องกันหรือตรวจสอบการฉ้อโกง การแฮ็ก (Hacking) การละเมิด หรือ การประพฤติมิชอบอื่นๆ ซึ่งเกี่ยวข้องกับการบริการของเรา
เพื่อตอบข้อซักถาม แก้ไขปัญหา ตรวจสอบเหตุการณ์ และจัดการข้อร้องเรียน
เพื่ออัปเดตและปรับปรุงการบริการของเรา รวมถึงการแจ้งให้ท่านทราบเกี่ยวกับการอัปเดตเนื้อหา กิจกรรม ไอเทม คอสตูม หรือสินค้าต่างๆ ที่เกี่ยวข้อง รวมถึงการอัปเดตซอฟต์แวร์ และจากแจ้งปิดเซิร์ฟเวอร์เพื่อปรับปรุงการให้บริการ
เพื่อให้เป็นไปตามกฎหมาย ข้อบังคับ กระบวนการทางกฎหมาย หรือ คำขอของรัฐบาลที่บังคับใช้
การดำเนินการทางการเงินและการตลาด และ/หรือ ตามที่ถูกกำหนดโดยข้อกำหนดและเงื่อนไขของธุรกิจ
เพื่อแจ้งเตือนการปรับปรุงและเปลี่ยนแปลงข้อกำหนดในการให้บริการนโยบายความเป็นส่วนตัวฉบับนี้ รวมถึงการบังคับใช้ข้อกำหนดและเงื่อนไขที่เกี่ยวข้องที่กำหนดไว้ในนโยบายดังกล่าว
เพื่อเปิดใช้งานการสื่อสารระหว่างผู้ใช้งานแอปพลิเคชันด้วยกัน
ป้องกันอันตรายต่อสิทธิ ทรัพย์สิน หรือความปลอดภัยของบริษัท ของผู้ใช้งาน หรือ ของประชาชนตามที่กฎหมายกำหนดหรืออนุญาต

ทางเราทำการประมวลผลข้อมูลส่วนบุคคลของท่านบนฐานข้อมูล อุปกรณ์ และเซิร์ฟเวอร์ของเรา ได้แก่ Google Firebase (กูเกิล ไฟร์เบส) ที่ใช้มาตรการ การพิสูจน์ตัวตน (Authentication), การอนุญาต (Authorization) และ การกำหนดเงื่อนไข (Data Validation) ในการรักษาความปลอดภัยของข้อมูลส่วนบุคคล

การเปิดเผยข้อมูลและการส่งต่อข้อมูลไปยังบุคคลที่สาม

โดยปกติแล้ว ทางเราจะไม่เปิดเผยหรือโอนข้อมูลส่วนบุคคลของท่านไปยังบุคคลอื่น อย่างไรก็ดี เราอาจเปิดเผยและส่งต่อข้อมูลดังกล่าวให้กับผู้ให้บริการบุคคลที่สาม เช่น เครือข่ายโฆษณา และผู้ลงโฆษณา นอกจากนี้ ทางเราอาจเข้าไปมีส่วนร่วมกับผู้ให้บริการโซลูชั่น ในการจัดทำกิจกรรมการตลาดร่วม เพื่อดำเนินการส่งเสริมการขาย หรือทำการตลาดต่างๆ ที่เกี่ยวข้องกับแอปพลิเคชัน ทั้งนี้เราอาจแบ่งปังข้อมูลบางอย่างของท่านที่จำเป็นต่อการทำกิจกรรมการตลาดร่วมให้แก่พันธมิตรทางธุรกิจของเรา

การเปิดเผยข้อมูลจะเกิดขึ้นก็ต่อเมื่อทางเราได้ตกลงมีส่วนร่วม หรือจ้างผู้ให้บริการ หรือบุคคลภายนอกอื่น ที่มีหน้าที่ช่วยอำนวยความสะดวกในการให้บริการแอปพลิเคชันของเรา รวมถึง การประมวลผลการชำระเงิน การวิเคราะห์ข้อมูล การส่งอีเมล การบริการส่งเสริมการขาย และอื่นๆ ที่เกี่ยวข้องกับการให้บริการ บุคคลที่สามดังกล่าวอาจเข้าถึงข้อมูลส่วนบุคคลที่สามารถระบุตัวบุคคลของท่านได้ เพื่อดำเนินงานต่างๆ ภายในนามของเราเท่านั้น และบุคคลที่สามเหล่านี้มีหน้าที่คุ้มครองข้อมูลของท่านเพื่อวัตถุประสงค์อื่นใดที่นอกเหนือจากการร่วมงานกับเรา

การให้บริการต่างๆของเรา อาจมีการเชื่อมต่อไปยังเว็บไซต์ การให้บริการ และ/หรือ ข้อเสนออื่นๆจากบุคคลที่สาม เช่น การลงทะเบียนบนเว็บไซต์ ของผู้ให้บริการโฆษณาเพื่อรับชุดของขวัญ หรือ Item Code สำหรับแลกเปลี่ยนรางวัล หรือวิธีการอื่นใดที่มีลักษณะคล้ายคลึงกัน รวมถึงการบรรจุลง (Download) และสมัครใช้บริการ อีมูเลเตอร์ หรือโปรแกรมจำลองของแอนดรอยด์บนเครื่องคอมพิวเตอร์ ทางเราจะไม่รับผิดชอบและจะไม่รับผิดต่อท่านหรือบุคคลที่สาม หากท่านมีการโต้ตอบกับบุคคลที่สาม รวมถึงข้อมูลใดใดก็ตามที่ท่านได้ยินยอมให้ไว้กับโดยบุคคลที่สามด้วยตัวท่านเอง ทั้งนี้ท่านควรตรวจสอบนโยบายความเป็นส่วนตัวของบุคคลที่สามดังกล่าวอย่างถี่ถ้วนก่อนที่จะให้ข้อมูลแก่พวกเขา นอกจากนี้ หากท่านมีข้อสงสัยใด โปรดติดต่อบุคคลที่สามดังกล่าวโดยตรง

หากใบอนุญาตของคู่ค้าทางธุรกิจของเรา หรือบุคคลที่สาม หมดอายุหรือสิ้นสุดลง ซึ่งเกี่ยวข้องกับส่วนใดส่วนหนึ่งของบริการข้อมูลส่วนบุคคลของท่าน (รวมถึง ชื่อ ที่อยู่อีเมล และข้อมูลส่วนบุคคลอื่นที่สามารถระบุตัวบุคคลได้) ข้อมูลอาจถูกโอนไปยังบุคคลภายนอกที่มีใบอนุญาต กล่าวคือ ทางเราได้มีส่วนร่วมทางการตลาด หรือว่าจ้าง หรือเปลี่ยนแปลงบุคคลที่สามเป็นรายอื่น อย่างไรก็ดี ก่อนการโอนดังกล่าวจะเกิดขึ้น ทางเราจะแจ้งให้ท่านทราบเป็นลายลักษณ์อักษรตามลักษณะที่ได้อธิบายไว้ในนโยบายความเป็นส่วนตัวฉบับนี้

หากเรา มีการเปลี่ยนแปลงทางธุรกิจ เช่น การควบรวมกิจการเข้าด้วยกัน การถูกซื้อกิจการโดยบริษัทอื่น การขายสินทรัพย์ทั้งหมดหรือบางส่วน เกิดการล้มละลาย มีการปรับโครงสร้างองค์กร เป็นต้น หรือกระบวนการอื่นใดที่คล้ายกัน ทางเราอาจทำการถ่ายโอนข้อมูลทั้งหมดของท่าน รวมถึงข้อมูลส่วนบุคคลให้กับองค์กรที่รับช่วงต่อในการเปลี่ยนสภาพหรือทำโดยเป็นส่วนหนึ่งของกระบวนการดังกล่าว ทางเราจะแจ้งให้ท่านโดยเร็วผ่านช่องทางออนไลน์ของเรา

การเปิดเผยข้อมูลที่จำเป็นตามกฎหมาย

หากทางเราได้รับทราบว่าบริการของเราถูกใช้ในการก่ออาชญากรรมใดใดก็ตาม ซึ่งเป็นเหตุฉุกเฉินที่อาจก่อให้เกิดภัยคุกคามต่อความปลอดภัยของท่าน หรือบุคคลอื่น รวมถึงเมื่อทางเราจำเป็นที่จะต้องปกป้องสิทธิหรือทรัพย์สินของเรา ทางเราอาจทำการเปิดเผยข้อมูลส่วนบุคคลของท่านให้กับหน่วยงานราชการตามที่กฎหมายกำหนด เช่น เจ้าหน้าที่ของรัฐ หน่วยงานตุลาการ เป็นต้น

การจัดเก็บข้อมูลส่วนบุคคล

ทางเราจะใช้มาตรการที่เหมาะสมและปลอดภัยในการเก็บรักษาข้อมูลส่วนบุคคลของท่าน ข้อมูลเหล่านี้จะถูกจัดเก็บในฐานข้อมูล อุปกรณ์ และเซิร์ฟเวอร์ ได้แก่ Google Firebase (กูเกิล ไฟร์เบส)

อย่างไรก็ดี ทางเราไม่สามารถรับประกันได้ว่า จะไม่มีการเข้าถึงโดยไม่ได้รับอนุญาตโดยสิ้นเชิง มีความเสี่ยงบางประการที่อาจเกิดขึ้นได้ ได้แก่ การแฮ็ก (Hacking) หรือ การสูญหายของข้อมูล ซึ่งทางเราเลือกใช้ Google Firebase (กูเกิล ไฟร์เบส) เนื่องจากมีระบบการพิสูจน์ตัวตน (Authentication), การอนุญาต (Authorization) และ การกำหนดเงื่อนไข (Data Validation) ในการรักษาความปลอดภัยของข้อมูลส่วนบุคคล อีกทั้งยังเป็นผู้ให้บริการที่น่าเชื่อถือ และมีมาตรการดูแล Cloud Storage ระดับสากล ดังนั้น หากมีการละเมิดความปลอดภัยที่อยู่นอกเหนือการควบคุมของเรา ทางเราขอปฏิเสธการรับประกันหรือการรับรองใดๆ ที่เกี่ยวข้องกับการบำรุงรักษาข้อมูลของท่าน ทั้งนี้ ทางเราขอแนะนำให้ท่านใช้มาตรการที่เหมาะสมในการปกป้องข้อมูลส่วนบุคคลของท่านเอง รวมถึงเก็บรักษารหัสผ่านและข้อมูลที่ละเอียดอ่อนอื่นๆ มิให้เปิดเผยต่อบุคคลอื่นโดยเด็ดขาด

นอกจากนี้ ขอแจ้งให้ท่านทราบว่า ข้อมูลที่ถูกส่งต่อทางอินเทอร์เน็ตไม่ว่าจะเป็นทางอีเมล หรือ โดยแบบฟอร์มออนไลน์ทั้งที่เป็นของเราและไม่ได้เป็นของเรา มีความเสี่ยงที่อาจถูกคุกคามได้ ทั้งนี้ทางเราไม่สามารถรับผิดชอบต่อการคุกคามดังกล่าว และไม่สามารถรับประกันความปลอดภัยของข้อมูลดังกล่าวได้ ทางเราจะดำเนินการตรวจสอบ แก้ไข และดำเนินการตามขั้นตอนที่เหมาะสมตามสมควร เพื่อให้แน่ใจว่าข้อมูลส่วนบุคคลของท่านจะได้รับการปกป้อง ตามนโยบายความเป็นส่วนตัวฉบับนี้

หากท่านทำการปิดบัญชี ลบบัญชี หรือถูกยุติการให้บริการ ทางเราอาจจะยังเก็บข้อมูลของท่านไว้ เพื่อใช้เป็นข้อมูลในกรณีที่มีความจำเป็นในการปฏิบัติตามกฎหมาย ข้อกำหนดด้านกฎระเบียบ แก้ไขข้อพิพาทระหว่างสมาชิก ป้องกันการฉ้อโกง หรือ การละเมิด หรือข้อตกลงอื่นใดที่เราอาจมีกับผู้ใช้งานแอปพลิเคชัน

สิทธิการเข้าถึงข้อมูลส่วนบุคคล

ท่านมีสิทธิโดยชอบธรรมที่จะตรวจสอบ แก้ไข หรือ ลบข้อมูลส่วนบุคคลของท่านบนแอปพลิเคชันของเราได้ โดยการลงชื่อเข้าใช้บัญชีของท่าน และเลือกดำเนินการตั้งค่าบัญชีผู้ใช้ โปรดทราบด้วยว่า เราขอสงวนสิทธิ์ในการยกเลิกหรือลบการลงทะเบียน หากเราตรวจสอบแล้วพบว่าข้อมูลส่วนบุคคลที่ท่านระบุนั้นเป็นเท็จโดยเจตนาหรือเป็นการจงใจฉ้อโกง

โปรดทราบด้วยว่า ถึงแม้บัญชีของท่านจะถูกลบหรือถูกยกเลิกไปแล้ว ข้อมูลที่ท่านได้เคยเปิดเผย ส่งต่อ หรือเผยแพร่ไว้ อาทิเช่น การแสดงความคิดเห็น การโพสข้อความ การส่งข้อความพูดคุยผ่านช่องทางออนไลน์ การอ้างอิง รูปภาพต่างๆ หรือทรัพย์สินในเกมต่างๆ อาจจะยังคงปรากฏให้ผู้อื่นเห็นได้บนแพลตฟอร์มที่ท่านได้เลือกเปิดเผยด้วยตัวของท่านเอง รวมถึงบนสื่อต่างภูมิทัศน์ (Platform) การให้บริการของบุคคลที่สาม เช่น เว็บบอร์ด หรือ สื่อสังคม (Social Media) ซึ่งข้อมูลดังกล่าวอาจถูกคัดลอก ถูกจัดเก็บ หรือถูกเผยแพร่โดยผู้ใช้งานรายอื่น การลบหรือยกเลิกบัญชีของท่าน ไม่สามารถส่งผลให้ข้อมูลดังกล่าวหายไปได้ ทั้งนี้ทางเราไม่ขอรับรอง ไม่สามารถ และไม่มีหน้าที่ในการลบข้อมูลเหล่านี้ นอกจากนี้ ข้อมูลบางส่วนของท่านอาจจะมีการตกหล่นอยู่ในเซิฟเวอร์ หรือ Google Firebase (กูเกิล ไฟร์เบส) ซึ่งทางเราอาจจะไม่ทำการสำรองข้อมูลเหล่านี้ไว้

หากท่านพบปัญหาในการแก้ไข หรือลบข้อมูลส่วนบุคคลของท่าน ท่านสามารถส่งอีเมลถึงเราได้ที่ admin@brothers.pictures ในบางกรณี ทางเราอาจขอให้ท่านแสดงหลักฐานการยืนยันตัวตน เช่น ชื่อ นามสกุล ที่อยู่ รหัสไปรษณีย์ รหัสผู้ใช้งาน และ/หรือข้อมูลเกี่ยวกับการใช้แอปพลิเคชันครั้งล่าสุดของท่าน

ในกรณีที่ท่านได้เข้าถึงบริการของเราจากแพลตฟอร์มของบุคคลที่สาม เช่น บริการอีมูเลเตอร์ หรือโปรแกรมจำลองของแอนดรอยด์บนเครื่องคอมพิวเตอร์ ข้อมูลของท่านอาจถูกสำรองไว้ ซึ่งอาจถูกใช้ หรือเปิดเผยตามนโยบายความเป็นส่วนตัวของพวกเขา ซึ่งอยู่นอกเหนือการควบคุมของนโยบายความเป็นส่วนตัวฉบับนี้

ในกรณีที่ท่านได้ทำการเชื่อมต่อข้อมูลกับบริการของเราผ่านทาง SNS ท่านจำเป็นต้องปฏิบัติตามคำแนะนำของ SNS นั้นๆ ในการอัปเดตข้อมูล รวมถึงการเปลี่ยนการตั้งค่าความเป็นส่วนตัวของท่าน

การเปลี่ยนแปลงนโยบายความเป็นส่วนตัว

ทางเราขอสงวนสิทธิในการปรับปรุง แก้ไข หรือเปลี่ยนแปลงนโยบายความเป็นส่วนตัว โดยทางเราจะแจ้งให้ทราบถึงการปรับปรุง แก้ไข หรือเปลี่ยนแปลงดังกล่าวพร้อมกับวันที่มีผลบังคับใช้ สำหรับการอัปโหลดนโยบายความเป็นส่วนตัวดังกล่าว โดยการเข้าถึงหรือใช้บริการต่อไปหลังจากที่ทางเราได้โพสต์นโยบายความเป็นส่วนตัวที่ได้รับการปรับปรุง แก้ไข หรือเปลี่ยนแปลงแล้ว หรือแจ้งให้คุณทราบแล้วนั้น แสดงได้ว่าท่านยอมรับที่จะทำตามนโยบายความเป็นส่วนตัวที่ถูกปรับปรุง แก้ไข หรือเปลี่ยนแปลงแล้ว หากนโยบายความเป็นส่วนตัวที่ปรับปรุง แก้ไข หรือเปลี่ยนแปลงนั้นไม่สามารถเป็นที่ยอมรับของท่านได้ ท่านมีสิทธิเพียงอย่างเดียวคือการหยุดใช้บริการ การยกเลิกบัญชี หรือการลบบัญชี

การคุ้มครองความเป็นส่วนตัวของเด็ก

การให้บริการนี้ไม่ได้มีจุดประสงค์ในการใช้งานสำหรับเด็กอายุต่ำกว่า 13 ปี และทางเราไม่มีความตั้งใจในการรวบรวมข้อมูลส่วนบุคคลใดจากเด็ก หากทางเราพบว่ามีการเก็บข้อมูลส่วนบุคคลจากเด็ก โดยไม่ตั้งใจ ทางเราจะใช้มาตรการในการรักษาความปลอดภัยที่เกี่ยวข้องกับข้อมูลส่วนบุคคลของเด็กทั้งหมดในการลบข้อมูลดังกล่าวออกจากระบบโดยเร็วที่สุด

เราขอให้ผู้เป็นบิดามารดาหรือผู้ปกครองตามกฏหมาย โปรดสอดส่องและดูแลมิให้เด็กที่อยู่ภายใต้การปกครองของท่านส่งมอบข้อมูลส่วนบุคคลให้กับทางเรา ทั้งนี้หากมีการสมัครใช้งานโดยเด็กที่มีอายุต่ำกว่า 13 ปี ถือว่าท่านยินยอมให้เรารวบรวม ใช้งาน จัดเก็บ และส่งต่อข้อมูลส่วนบุคคลนั้น และท่านยินยอมและตกลงที่จะมีภาระผูกพันธ์ตามเงื่อนไขที่กำหนดไว้ในนโยบายความเป็นส่วนตัวฉบับนี้ หากเราพบบัญชีผู้ใช้ของเด็กอายุต่ำกว่า 13 ปี และเราเชื่อว่าได้รับข้อมูลส่วนบุคคลจากผู้มีอายุต่ำกว่า 13 ปี โดยปราศจากการยินยอมจากบิดามารดาหรือผู้ปกครองตามกฏหมาย เราจะทำการปิดบัญชี และลบข้อมูลส่วนบุคคลดังกล่าว

นอกจากนี้ หากท่านทราบว่าบุตรหลานของท่านได้ทำการติดตั้ง ลงทะเบียนบัญชีผู้ใช้ และ/หรือเข้าใช้งานแอปพลิเคชันของเรา เราขอให้ผู้ปกครองแนะนำบุตรหลานของท่าน และคอยสอดส่องพฤติกรรมการใช้งานอินเทอร์เนตของบุตรหลานของท่าน มิให้เปิดเผย ชื่อ-นามสกุล ที่อยู่ หรือหมายเลขโทรศัพท์ โดยไม่ได้รับอนุญาตจากผู้ปกครอง

การใช้กล้องหน้า และการบันทึกใบหน้า

เมื่อท่านเข้าถึงคุณลักษณะเฉพาะ (features) “AR Face” ของแอพพลิเคชั่น YAKLAND หรือ ดินแดนยักษ์ ท่านสามารถเลือกอนุญาต หรือ ปฏิเสธการเข้าถึงกล้องหน้า (front camera) ได้ ทั้งนี้ หากท่านเลือกอนุญาตการเข้าถึงกล้องหน้า ท่านสามารถเลือกใช้ AR Filter ที่ทางเราจัดสรรไว้ให้ และสามารถบันทึกภาพภ่ายของท่านลงในอุปกรณ์ที่ท่านติดตั้งแอพพลิเคชั่นของเราไว้
ภาพถ่ายของท่านจะไม่ถูกแสดงผล (display) บนแอปพลิเคชัน YAKLAND หรือ ดินแดนยักษ์ และทางเราจะไม่มีการบันทึก เปิดเผย หรือโอนข้อมูลใบหน้าของท่านไปยังบุคคลอื่น อย่างไรก็ดี หากท่านทำการส่งต่อ (share) หรือเปิดเผยรูปภาพที่ถ่ายด้วย AR Face ในพื่นที่ซึ่งเป็นสาธารณะ เช่น บัญชีโซเชียลมีเดียของท่าน ถือว่าท่านให้สิทธิต่อผู้อื่นในการรวบรวมข้อมูลและใช้งานข้อมูลดังกล่าวได้ การเผยแพร่ดังกล่าวอยู่นอกเหนือการคุ้มครองโดยนโยบายฉบับนี้ ดังนั้น ทางเราขอแนะนำให้ท่านโปรดระวัง และใช้ดุลยพินิจในการเปิดเผยข้อมูลใบหน้าของท่านอย่างถี่ถ้วน
ท่านสามารถปิดการเข้าถึงกล้องถ่ายรูปได้ตลอดเวลา โดยการตั้งค่าความเป็นส่วนตัว (Privacy Setting) บนอุปกรณ์ของท่าน โดยไปที่การตั้งค่า (Settings) > ความเป็นส่วนตัว (Privacy) > กล้อง (Camera) > กดสลับปุ่ม YAKLAND ให้เปลี่ยนเป็นสีเทา
เมื่อท่านทำการปิดบัญชีผู้ใช้งาน ข้อมูลใบหน้าของท่านจะถูกลบออกจากอุปกรณ์ของท่านทันที แต่อาจไม่ถูกลบออกจากพื่นที่ซึ่งเป็นสาธารณะ โปรดทราบด้วยว่าการจัดการและลบข้อมูลบนพื้นที่สาธารณะเป็นความรับผิดชอบของท่านแต่เพียงผู้เดียว และทางเราไม่มีหน้าที่ในการจัดการและลบข้อมูลเหล่านั้นทุกกรณี

การดาวน์โหลด/ติดตั้ง และการลงทะเบียนใช้งานนอกราชอาณาจักรไทย

บริษัทของเราเป็นบริษัทสัญชาติไทย การดำเนินธุรกิจส่วนใหญ่เกิดขึ้นภายในราชอาณาจักรไทยเป็นหลัก ดังนั้น นโยบายความเป็นส่วนตัวฉบับนี้ อยู่ภายใต้กฎหมายและข้อบังคับใช้ของประเทศไทยเท่านั้น

หากท่านเป็นผู้ใช้บริการของเราจากต่างประเทศ หมายความว่าท่านได้ยินยอมให้ข้อมูลส่วนบุคคลของท่านถูกส่งต่อ จัดเก็บ ใช้ และดำเนินการภายในประเทศไทย และ/หรือในประเทศอื่นๆที่ Google Firebase (กูเกิล ไฟร์เบส) เลือกเป็นสถานที่จัดตั้ง Cloud Storage กล่าวคือท่านได้ทราบดีแล้วว่า ข้อมูลส่วนบุคคลของท่านอาจถูกใช้งานและประมวลผล ส่งต่อ รวมถึงจัดเก็บนอกถิ่นที่อยู่ของท่าน

รายละเอียดของบริการ

การดาวน์โหลดและติดตั้ง YAKLAND App ผู้ใช้จะเป็นผู้รับผิดชอบจัดหาเครื่องคอมพิวเตอร์ อุปกรณ์สื่อสารเคลื่อนที่/อุปกรณ์ดิจิตอลอื่นๆ ระบบปฏิบัติการ วิธีการเชื่อมต่อสื่อสารและกระแสไฟฟ้า ฯลฯ ซึ่งจำเป็นต่อการใช้บริการฯ ทั้งนี้ ผู้ใช้เป็นผู้ออกค่าใช้จ่ายเองทั้งสิ้น
คุณลักษณะพิเศษ (Features) ที่เกี่ยวข้อง เช่น โปรไฟล์ของคุณและผู้ใช้รายอื่น ตัวละครสมมุติ การจับสัตว์เลี้ยงหรือสิ่งอื่นใดในเกมที่มีลักษณะคล้ายคลึงกัน สถานที่เช็คอิน คะแนน การจัดอันดับ และอื่นๆที่อาจมีขึ้นในอนาคต
การถ่ายรูปกล้องหน้า (AR Face) และกล้องหลัง (AR)
การเชื่อมต่อ YAKLAND App กับแอพพลิเคชั่น Social Network Service (SNS) ในการสร้างบัญชีผู้ใช้

การใช้ภาษา

นโยบายความเป็นส่วนตัวฉบับนี้ จัดทำขึ้น 2 ภาษา คือ ภาษาไทย และ ภาษาอังกฤษ หากท่านได้รับคำแปลเป็นภาษาอื่นนอกเหนือจากนี้ ไม่ว่าจะด้วยวิธีการใดก็ตาม โปรดทราบว่าการแปลนั้นมีไว้เพื่อความสะดวกของท่านเท่านั้น และท่านทราบดีว่านโยบายความเป็นส่วนตัวฉบับภาษาอังกฤษจะถูกบังคับใช้แทนฉบับแปล

Information to be registered at the time of creating an account, which will be collected, shared, and used by us as follows,

History of services

We will collect all the details and data while you are using our application, for example; number of time you spend on our application, score, and ranking. Including purchasing Virtual Goods, spending Virtual Money and Point Exchanging.

We also gather interaction and communication between users including sharing our application on your social media, for example; invitation, score and rank sharing, screen capture sharing, etc.

Once you purchase any goods, items, or costume that is selling on our application, in the other words, you buy any Virtual Goods or spend Virtual Money. The Payment Service Provider will collect your billing information and also any related information as follows,

Your first name and last name
Your email address
Your Credit Card, Mobile Banking, or The Payment Service Provider (PSP) such as PayPal or True Money Wallet, etc.
Your address for invoice/tax invoice
Our alliance or the third party may receive this information when you pay through mobile phone/digital devices

Furthermore, the information which you sent to us in terms of problem report, complaint, and advice, will be gathered. Your email address and the conversation between you and us will be stored in order to improve our services.

The application features that we provide

One of the features that we provide is User Profile (“Profile”). It is a representation or a short description of yourself. You can customize your profile to display your nickname, game information, add friends, rank, challenge, and/or any in-game communication between users. Chat Box, which is a public space, should be provided as well. Once you share your Personal Data or upload any pictures for your purpose, it means you consent everyone to collect, use, and share your Personal Data. This sharing of yours is beyond the protection of this Policy. Thus, we recommend you to be prudent and use discretion before sharing any of your Personal Data.

Personal Data collected through SNS

When you use a Social Network Services (SNS) and approve us to access any of information through the SNS including the Application Programming Interface (API) of SNS, the information we collect through the SNS are the following,

Your first name and last name
Your profile picture
Your Identification card number (if any)
User ID number
Your email that you use to apply for the SNS
Your physical location information and your digital devices
Gender

Once you register, connect, and/or use our application through SNS, we are authorized to collect, store, use, and share the information on the SNS through API according to the terms in this Privacy Policy. Your consent will appear as evidence once you “accept” or “allow” (or any other comparable conditions) our application on the SNS.

Location Information

When you are using the YAKLAND App, please make sure that the Location Services (or any other comparable conditions) on your mobile phone/digital devices are on. Regarding our services, we may access, process, and collect the current location information of your device and a person nearby you, or the detected location information of your device and a person nearby you. We may use various technologies to specify the location, for instance; Internet Protocol (IP), Global Positioning System (GPS), sensor, or other compatible technologies. This procedure may supply your information from your mobile phone/digital devices, which are close to a Wireless Fidelity (Wi-Fi) router or Signal Tower, and also your mobile phone carrier.

Tools required for Personal Data collection

Cookies are text files with small pieces of data, which will be promptly created when you use a Web Browser and will be stored on your computer. Normally, the data stored in a cookie will exclude your Personal Data, in the case where your Personal Data needs to be stored, it will be locked by a password to protect it from third parties. We may use it to track your general data which is not your personal data, for example; username and game progress, etc. The purpose of use of this technology is for analytical statistics and marketing only. Furthermore, we may use Flash Cookies. It is a related tool for preventing fraud, retaining game settings, and tracking your game progress. However, you can reject or manage some kind of Cookies, but such actions could prevent you from entering some features of our services. Please be informed that you have allowed Flash Cookies to function and will not delete Flash Cookies.

Log Files

Log files are a computer-generated data file that contains information of usage patterns, entrance, destination, route, time, date, quantity, period of time, type of services, activities, and operations associated with a computer communication system. We will save Log Files on our Server. Data stored in Log Files contains your computer or mobile device’s Internet Protocol (IP), browser, language of browser, application, email address, internet service provider, referring, type of computer platform, date/time stamp, and user activities. We intentionally use this information only for analyzing our services to improve and develop our services. The data stored in this file consist of the user account, setting, notification setting, along with other necessary information. Some of this information, or maybe all of it, will be copied on our Backup Server, which we will perform frequently.

Web Beacons

Our services may use Web Beacons, Tags, or Tags Pixel. Web Beacons are tiny graphic pictures that are allocated on our services or platform. It is implemented to analyze the frequency and visit pattern of the user. Web Beacons will select advertisements that are most related to your interest. This procedure may send information to other parties. Anyhow, it will not specify your identity, address, and telephone number.

Application advertisement on third-party services

We may use an advertisement service through a third party. This third party may use Cookies, Web Beacons, or any other tools (or comparable tools) on your computer and mobile phone/digital devices. They may use the collected information to evaluate the efficiency of their advertisement. Please be noted that this Personal Data is non-personally identifiable. We may share your unidentified information as an application user. Moreover, this collection is applied under the privacy policy of the third party. We will not responsible to any activities of yours that provide your Personal Data or has any interaction to the third party. We encourage you to carefully read their privacy policy. If you have any questions, please contact them directly.

Link clicking or URLs

In case there is a communication between you and us through any channels; such as email or notification on our application; there may contain a Link or Uniform Resource Locator (URLs) that connect to other contents about our services. We will track your information via the given Link or URLs, to analyze your interest in our application.

Purpose of collect and share of Personal Data

We will not use or disclose your Personal Data. We may share it to a third party who provides advertisement services or other services that are related to this application. The purposes are the following,

We will process your Personal Data on our database, tools, and server called Google Firebase, which has Authentication, Authorization and Data Validation system as a preventive measure to protect your Personal Data.

Data disclosure and transfer to third-party

We normally do not disclose your Personal Data to other people, however, we may share or transfer the data to a third-party service provider; such as an advertising network or advertising media. Furthermore, we may cooperate with the Solution Provider, in order to co-marketing and promote marketing campaigns, or any marketing methods that are relevant to our application. We may share or transfer your Personal Data with our alliance if necessary.

The data revelation will occur only when we have agreed to cooperate or hire the third-party, subcontract, or outsource services, inclusive of payment processing, data analysis, email address, sales promotion, etc. This third party may access your Personal Data that can define your identity. The operation will only occur in the name of our company and the third party has their duty to prevent any unauthorized use apart from our services.

Our services may link to a website, service, and/or offer from a third party; such as, your registration on an advertisement website in exchange to get a Gift Code or Item Code (or any comparable conditions), and downloading and register to use an Android Emulator on your computer. We cannot be responsible and will not plead guilty to you or the third party. If you respond to a third-party service or give your Personal Data or any other information to them, we encourage you to carefully review their Privacy Policy before giving them such information. Besides, please contact them directly when you have any further concerns.

In case the third-party or our alliance’s business license is terminated or expired if the license is related to any apart of using your Personal Data (including name, email address, and your identification), the Personal Data will be transferred to another third-party, in other words, we change the co-marketing team, hire another outsource services, or replace a new subcontract. Before transferring the data, we will notify you in writing regarding the terms of this Privacy Policy.

In addition, if there is a consideration to merge our company with others; either merger, sell, buy, or any other comparable conditions; your Personal Data may be transferred due to business alteration. Some or all of your Personal Data may be transfer due to the business alteration process. We will notify you about the data transfer on our platform.

Data disclosure due to the law

If we acknowledge that our services are involved with a criminal offense, which is an urgent circumstance that threatens your safety, and also when we need to protect our rights and assets. We may disclose your Personal Data subject to the law, regulations, court decree or court writ, request for prosecution, and our belief that should comply with the law. We will notify you immediately when your Personal Data is disclosed to the government agencies.

Storage of Personal Data

We are taking a proper technical and security measures to store your Personal Data. The data will be stored in the database, tools, and server called Google Firebase.

We cannot guarantee that there is a completed protection from unauthorized access. There is some risk that may occur; for example, hacking and data loss. To prevent this matter, we use Google Firebase because it has Authentication, Authorization and Data Validation system. Google Firebase is a world-class Cloud Storage provider and has reliable preventive measures to protect user’s Personal Data. Therefore, if there is any security breach that is beyond our control, we refuse to guarantee or ensure the maintenance of your Personal Data. We recommend you use your proper measures to protect your Personal Data, to conceal your password or any sensitive information from others.

Additionally, please be noted that the information sent through email, or filling an online form (which is ours and not ours) are risky. We cannot be responsible for the risk and cannot guarantee the security of the data. We will investigate, resolve, and operate properly to ensure the protection according to the terms of this Privacy Policy.

Your Access Rights to Personal Data

You have a full right to access, validate, edit, or delete your Personal Data on our application by logging in to the system and resetting your account. Please be informed that all rights reserved by us to cancel or delete your registration when we found your registration is a falsification.

Please be noted that even if your account has been deleted, some of the information or all of the information that you have shared, sent, or posted; for instance, comment, chat, reference, photo, and/or in-game asset; still be available for other people on a platform you selected to do so; including our application and other companies’ application, and also a platform servicing by the third-party; for example, Web-board or Social Media. Such information could be copied, stored, saved, or shared by other users. Deleting your account will not affect such information to be deleted. We cannot and have no obligation to delete such information and it shall be made at the sole discretion of our company. Additionally, some of your Personal Data may not completely be erased from the server, However, we will not back up the data.

If you have any problem editing or deleting your Personal Data, please email us at admin@brothers.pictures. In some cases, we may ask you to prove your identity; such as name, surname, address, postcode, username and password, and/or your latest activity on the application.

If you access our service from a third-party platform; such as Android Emulator on your computer, your Personal Data may be reserved, copied, used, or disclosed due to their privacy policy, which is beyond the control of this Privacy Policy.

If you connect our services to your SNS application, you should act according to your selected SNS in terms of updating your data or changing your Personal Data setting.

Changes to this Privacy Policy

The changes in this Privacy Policy shall be made at the sole discretion of our company at any time. We will notify you about the change and the date of enforcement. Continuing to use our services after a notice of changes means you accept the changes and consent to the modified version. If you do not agree to any of the changes, you only have a right to cancel or delete the account.

Front camera and Face Data collection
When you use one of YAKLAND’s feature, which is called “AR Face”, you can select either accept or decline our application to access your front camera. If our application is allowed to access your front camera, you can use AR Filters that we provided in this feature. You are also able to save your photo into your device.
Your photo or face data will not be displayed on the YAKLAND application. We will neither save, disclose, or transfer your Face Data to other parties. Nevertheless, if you share or disclose your photo, which was taken through our AR Face feature, on other platforms; for example, your social media account, it means you consent everyone to collect, use, and share your Face Data. This sharing of yours is beyond the protection of this Policy. Thus, we recommend you to be prudent and use discretion before sharing any of your Face Data.
You can disallow the camera access at any time by changing Privacy Setting on your device. You can go to Settings > Privacy > Camera > and switch the YAKLAND button into grey color.
Once your account is deleted, your photo which was taken through our AR Face feature, will be removed immediately; however, it may not be removed from other platforms. Please be noted that it is your sole responsibility to manage and delete such data. We cannot and have no obligation to manage and delete such data in any cases.

Privacy of children

This service is not eligible for children under 13 years old. We will not internally collect children’s Personal Data. If such data was unintentional collected, we will delete the data immediately.

We are requesting the parents and legal guardians to always inspect and take care of your children who are under 13 years old. Please prevent them from sending their Personal Data to us. Thus, if your children make a registration on our services, it means you implicitly allowed your children’s Personal Data to be collected, used, stored, shared, and transferred, and you also implicitly accepted the terms on this Privacy Policy. In case we found a registration from children under 13 years old and believe this registration is unapproved by their parents and legal guardians, we will cancel such account and delete the data.

If you are aware that your children install, register, and/or use our application, we encourage you to consult them, pay close attention to their behavior of using the internet, and prevent them from disclosing their Personal Data without asking permission from parents/guardians.

Download/installation and registration outside the Kingdom of Thailand

Our company is Thai. Most of our business runs in the Kingdom of Thailand, therefore, this Privacy Policy is under the Law of Thailand.

If you are a user from other countries, you agree to consent your Personal Data to be transferred, stored, used, and processed in Thailand and/or in other countries regarding the Google Firebase’s Cloud Storage location. You are aware that your Personal Data will be collected, transferred, shared, stored, and processed outside your local residence.

Users shall supply the necessary mobile phone/digital device and computer, operating system, communication device, data connection, and electricity that necessary for using our services under users' own responsibility and at Users' own expense.
Application features and any relation features; such as user profile, in-game character, pet (or any comparable things) catch and collection, check-in location, game point, ranking, and any features which may be included in the future.
Front-facing camera (AR Face) and camera (AR) to take a photo.
Connect YAKLAND App through Social Network Service (SNS) to create an account.
Location Service provided by various technologies to specify the location; for instance, IP address, Global Positioning System (GPS), sensor, or other compatible technologies.
Location check-points or check-in appear on the application.
Gameplay, such as mini-game and game level.
A chatbot system. It is arranged for user to question about information of the locations appear on the application.
Our accessible services on the application. For example, virtual goods shop, spending virtual money, and game point exchanging.

This Privacy Policy was written in 2 languages, which is Thai and English. If you review this Policy in other languages or any translation form, please be noted that it is only for your convenience. The English version of this Privacy Policy will be enforced instead of the translation version.
